Questions to the US delegation during their visit to Cuba

As we know the Government of the United States expresses the wish that the Cubans who live in the island have the same rights of US citizens. Therefore, it is desirable to study some of the US laws that could be applied in Cuba. We believe that perhaps it would be interesting for the delegation that accompanies the US president to answer some questions asked by national and international journalists.

The three questions are interrelated:


QUESTION 1

The United States has expressed the will to promote civil society in Cuba as well as democratic rights. Will the United States government explain the functioning of some of its laws? For example:

Code of the US 18 USC § 953 [1948] – better known as the Logan Law:

The Law says: “Any US citizen regardless of where that person lives and that, without authorization of the United States, begins or develops direct or indirect actions related or in correspondence with a foreign government and any official or agent, intending to influence measures or conduct of any government in any dispute with the US or to annul measures of the United States shall be fined and/or jailed for no longer than three years or both. “The Cuban government just needs to substitute the “United States” by the Republic of Cuba”.

Question 2

On the other hand, the United States also has legal legislation that is of key importance: The Law of Domestic Security of 1950. What would happen if Cuba responds to the law of the United States and applies that law to the persons who – according to US law – could be considered agents of a foreign power”? In the case of the Cubans who receive funds from the government of the United States and its agencies; it would be necessary – as occurs in the US – to register as agents of a foreign power”? Question 3

If a Cuban citizen receives fund from the United States; does that person have to report the income for taxation in the United States for the IRS to determine if these incomes respond to the payment of taxes or not? The corresponding laws stipulate:

“For an exemption stipulated by the law of the United States, the US Deparment of States must verify if that persons performs similar services to those done by employees of a foreign government to receive an extension equal to the employees of the United States government who work under similar conditions in their country or are considered established by facts”.
